Terms of Use

Please read these Terms of Use carefully before using our services. By creating an account, starting a trial, purchasing a subscription, or using the smoonb software (including the CLI), you agree to comply with these Terms and you accept the ethical and legal responsibilities related to your use of the services. Goalmoon may suspend or terminate your access, without refund, if we determine that your account or license is being used in an inappropriate, unlawful, or abusive manner.

Goalmoon Tecnologia LTDA (hereinafter “Goalmoon”) – Terms of Service and Acceptable Use Policy for smoonb.

Service Abuse

Any attempt to disrupt, compromise, reverse engineer (except where legally permitted), or cause harm to our services, infrastructure, users, or customers may result in immediate termination of your account and license, and may lead to legal action. Any unauthorized attempt to access other users' accounts, systems, or data is strictly prohibited.

Any violation of these Terms may result in actions by Goalmoon, including warnings, temporary suspension, license revocation, termination of your account, and other measures, with or without prior notice, depending on severity.

Key Provisions

• smoonb is a private software product provided by Goalmoon, headquartered in Londrina, PR, Brazil.
• Goalmoon may suspend or terminate accounts and licenses for violations of these Terms, for security reasons, for suspected fraud, or when required by law.
• Goalmoon may update these Terms at any time. When changes are significant, we may provide notice through the website, the app, or email, when applicable.
• You are responsible for all activity performed under your account, your devices, and your license key.
• You must comply with all applicable laws and regulations when using smoonb.

Primary Usage Restrictions

• You may not use smoonb to facilitate unauthorized access, credential theft, phishing, malware distribution, or any other harmful activity.
• You may not attempt to bypass licensing, subscription checks, usage limits, or security controls.
• You may not interfere with or disrupt the normal operation of the services or attempt to overload, scan, or stress systems in a way that degrades availability.
• You may not use smoonb to process data you do not have the legal right to access, export, or back up.
• You may not distribute or resell the software or your license, except if explicitly allowed in a written agreement with Goalmoon.

Prohibited Uses

You agree NOT to use smoonb or Goalmoon services to:

• Engage in illegal activity, including attempts to compromise systems, accounts, networks, or data.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Upload, publish, transmit, or make available any content or data that is unlawful, harmful, threatening, abusive, defamatory, or that violates the privacy or rights of others.
• Infringe intellectual property rights, including distributing content or data you do not have the rights to use or process.
• Distribute viruses, malware, ransomware, or any code designed to disrupt, destroy, or limit the functionality of software, hardware, or telecommunications equipment.
• Interfere with or disrupt services, servers, or networks connected to the services, or violate any applicable policies or regulations.
• Intentionally or unintentionally violate any applicable local, national, or international law.
• Collect or store personal data about others in connection with prohibited conduct or without a lawful basis.

User Responsibilities

• Maintain an active subscription after the trial period ends, where required, to continue using smoonb and its features.
• Keep your license key, access credentials, and devices secure. You are responsible for any actions performed using your credentials and license.
• Provide accurate and up-to-date registration information. If your information is false, incomplete, or outdated, Goalmoon may suspend or terminate your account and license.
• Use smoonb only for data and systems you are authorized to access and process. You are solely responsible for ensuring you have the legal right to back up, export, restore, or otherwise process any data handled by smoonb.
• Maintain your own backups and safeguards. While smoonb helps you create backups, you are responsible for verifying integrity, testing restores, and ensuring your procedures meet your operational and compliance needs.
• Comply with all applicable data protection laws and security best practices relevant to your use case.

You must not:

• Attempt to bypass or defeat licensing controls, subscription enforcement, or security measures.
• Use smoonb in a way that creates unreasonable load, degrades service performance, or impacts other users.
• Use smoonb as part of a malicious workflow (including hacking, cracking, phishing, or malware distribution).

Goalmoon Responsibilities

• Use reasonable efforts to provide the services with reliability and security consistent with our operational standards.
• Perform maintenance and updates as needed, including security patches and improvements. When feasible, maintenance that may impact availability will be scheduled during lower usage periods.
• Provide support channels and basic guidance for product usage as described in our documentation. Support does not include custom development, bespoke configuration, or legal/compliance consulting.
• Protect account data with access controls and operational safeguards. However, no system can be guaranteed 100% secure, and you acknowledge that risks inherent to software and internet-based services exist.
• Comply with lawful requests from competent authorities and court orders when applicable.

Account Creation, Trial, License, and Subscription

To use the smoonb CLI, you must create an account in our desktop platform, generate a valid license, and have an active subscription after the end of the trial period. If your trial ends and you do not maintain an active subscription, the CLI will not work.

• Trials, when offered, are provided for evaluation purposes and may be subject to feature, time, or usage limitations.
• Licenses are personal to the account (or organization, when applicable) and must not be shared, resold, or redistributed unless explicitly authorized in writing by Goalmoon.
• Goalmoon may suspend or revoke a license in cases of non-payment, suspected fraud, security concerns, or violations of these Terms.

Payment Policy

• Subscription fees are charged according to the plan you select and the billing cycle you choose at checkout (monthly or otherwise, if available).
• If payment fails or is overdue, access to the services and your license may be suspended until the outstanding amounts are settled.
• Goalmoon may change pricing with prior notice when required by applicable law or by the terms of your plan.

Login and Access Credentials

• You are responsible for maintaining the confidentiality of your login credentials and license-related secrets. Do not share them with unauthorized users.
• Goalmoon is not responsible for losses arising from the unauthorized use of your account caused by your failure to protect credentials.

Refund Policy

• If a refund policy is offered for your plan, the conditions (eligibility, deadlines, and process) will be described during purchase or in the billing area of your account. Some charges may be non-refundable, such as fees imposed by payment processors.
• Promotional discounts may be non-recurring and may apply only to the first billing cycle, unless explicitly stated otherwise.
• Goalmoon may deny refunds in cases of misuse, policy violations, fraud, chargeback abuse, or when required to prevent harm to the platform and other users.

General Terms

• To the maximum extent permitted by law, the services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• To the maximum extent permitted by law, Goalmoon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the services.
• You agree to indemnify and hold harmless Goalmoon and its affiliates, directors, officers, employees, and partners from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
  • Your breach of these Terms.
  • Your violation of any applicable law or regulation.
  • Your infringement of any third-party rights.
  • Your unauthorized or unlawful use of the services.
• Goalmoon may change technical procedures and operational policies as necessary for security, maintenance, and service improvement.
• If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Venue and jurisdiction: these Terms are governed by the laws of Brazil. The parties elect the courts of Londrina, Paraná, Brazil, as the exclusive forum to resolve disputes, to the extent permitted by law.
